You perform an existing melody, lyric or distinctive composition again without copying the original audio. Composition permission remains the central issue.
A faithful version of a song may have different licensing routes from an altered, adapted or substantially rearranged work. Requirements vary by usage and territory.
An independently created idea may have no borrowed copyright element, but similarity alone does not settle whether permission is required.
A producer can recreate the sound of a bass instrument without copying the audio. That addresses one issue, not every issue. The musical composition may still be protected depending on what has been used and the facts of the work.
Ask three things: was the original recording copied; was recognisable musical or lyrical material borrowed; and do existing contractual arrangements or credits affect the proposed release?
Changing the sound, key, tempo or singer is not by itself evidence that the underlying song is free to use.
Owning the recording you made does not automatically grant rights to a borrowed composition. Conversely, a writing credit or share of the composition does not necessarily entitle you to distribute someone else’s original master.
For older garage and house recordings with multiple collaborators, identify the exact work, recording, versions and original agreements before deciding how to issue a remix or re-record.
